Windows 8 Professional from Dream Spark Premium and serial key limitations RRS feed

  • Question

  • Respected,

I have Windows 8 Professional downloaded from Dream Spark Premium with serial key. Now I've read on the Dream Spark Premium page and there FAQ's that there is some products that are single-use only and therefor I can only use it once. My question is, how can I know if my Windows 8 Professional downloaded from Dream Spark Premium is singe-use only? And if it is not, does that mean that I can install the same product (in this case Windows 8) on 2 computers? I am just worried if I will have activation problems. Also I am a student and like that, my use of Windows 8 is for my studies.

    Thanks

P.S: I am not sure where to post this question, under which category as I couldn't find any similar for my question.

  • from what i understood upon using Windows 7 (three different version from two different university accounts), Visual Studio 2010 from Dream Spark, you can install the software as many times as you wish.

HOWEVER; you can only activate the application on only two seperate PC. read the EULA, it is quite clear if u ask me:

    DreamSpark EULA

    Product
Microsoft Windows 8 Professional 64-bit (English) - DreamSpark - Download

SUBSCRIPTION AGREEMENT - MICROSOFT DREAMSPARK STUDENT

This is a subscription agreement (“agreement”) between Microsoft Corporation (or based on where you live, one of its affiliates) and you for the Microsoft DreamSpark student offering (“Student Subscription”). Please read it. For purposes of this agreement the term “software” applies to the software provided to you under the Student Subscription, which includes the media on which you received it, if any.

    1. DEFINITION OF YOU OR YOUR. "You" or “your” means a person enrolled in and attending courses that lead to academic credit or certification through an educational institution.

    2.TERMS FOR STUDENT SUBSCRIPTION.

Student Subscription. Subject to the terms of this agreement, the Student Subscription provides subscription to access software. Microsoft may change the software or other offerings that it makes available under the Student Subscription at any time without prior notice to you.
End of Student Status. If you no longer qualify for the Student Subscription (by failing to meet the definition of "you" above), then your Student Subscription will terminate; however, you may continue to use the software you obtained prior to termination of your student status subject to the terms of this agreement.
Termination. Microsoft may terminate the entire DreamSpark program or your specific Student Subscription at any time without prior notice to you for any reason or no reason.

    3. STUDENT SUBSCRIPTION RIGHTS.

Student Subscription Software. Except for terms that explicitly state that they override these terms, the terms of this agreement supersede and control over any conflicting license terms you may encounter in the software, even if installation of the software requires you to “accept” a separate end user license agreement or if you are otherwise obligated to accept other terms.
Installation and Use Rights. You may install and use on your devices no more than two copies of each of the software offerings made available to you through the Student Subscription, but only (a) to support your education; (b) in non-commercial research; or (c) to design, develop, test, and demonstrate software programs for the above purposes. The Student Subscription and software are personal to you. You may not permit others to access the software using your Student Subscription. You may not transfer your Student Subscription.
Restrictions. You may not use the software provided as part of the Student Subscription::
for commercial purposes (except as permitted under Section 3(d); or
to develop or maintain your own administrative or IT systems.
No commercial use. If you use the Student Subscription software to create software programs, you may only commercially use or distribute them upon the purchase of appropriate commercial license(s) for the software. You may however submit software programs that you create using the Student Subscription software to Microsoft app stores, including for revenue.
Other terms. If your principal place of residence is in Germany, the following provision applies:

Using Windows Desktop Operating Systems. Your Student Subscription includes certain Windows desktop operating system products. You may not install any such product on any computer that is not already licensed to run a full version of a Windows operating system on it. Therefore, a valid Certificate of Authenticity (COA) for a Windows operating system must first be affixed to any such computer.

    4. NOT FOR RESALE SOFTWARE. You may not resell the software provided as part of the Student Subscription.

    5. SUPPORT SERVICES. Software and other services provided under the Student Subscription are provided “as is,” we do not provide support services for them.

    6. ENTIRE AGREEMENT. This agreement, and the terms for software, supplements, updates, Internet-based services and support services that you use, are the entire agreement for the software and support services.

    7. APPLICABLE LAW.

United States. If you acquired the Student Subscription in the United States, Washington state law governs the interpretation of this agreement and applies to claims for breach of it, regardless of conflict of laws principles. The laws of the state where you live govern all other claims, including claims under state consumer protection laws, unfair competition laws, and in tort.
Outside the United States. If you live in any other country, the laws of that country apply.

    8. LEGAL EFFECT. This agreement describes certain legal rights. You may have other rights under the laws of your country. This agreement does not change your rights under the laws of your country if the laws of your country do not permit it to do so.

    9. DISCLAIMER OF WARRANTY. The Student Subscription is provided “as-is.” You bear the risk of using/participating in it. Microsoft gives no express warranties, guarantees or conditions. You may have additional consumer rights under your local laws which this agreement cannot change. To the extent permitted under your local laws, Microsoft excludes the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

    10. LIMITATION ON AND EXCLUSION OF REMEDIES AND DAMAGES. You can recover from Microsoft and its suppliers only direct damages up to U.S. $5.00. You cannot recover any other damages, including consequential, lost profits, special, indirect or incidental damages.

    This limitation applies to

anything related to the software, services, content (including code) on third party Internet sites, or third party programs; and
claims for breach of contract, breach of warranty, guarantee or condition, strict liability, negligence, or other tort to the extent permitted by applicable law.

It also applies even if Microsoft knew or should have known about the possibility of the damages. The above limitation or exclusion may not apply to you because your country may not allow the exclusion or limitation of incidental, consequential or other damages.

  • Hi Dave,

Thanks for reply but I have already been on that page, but whenever I try to contact them and send my question I keep getting a message that says "We're sorry, the resource you are looking for is unavailable at this time." I don't know if that is because I have some problem on my browser or something, but I tried that page for a few days now, thinking "I should try it later". Any advice on what should I do about that page?

However. First time I read about that single-use serial key is on that page as well. When I choose option that I am student and then downloads, there is a question saying "Can I install my software on two computers at once?" and there it says "Yes, as long as you are the owner of both computers and both are being used for educational purposes. Friends, family and colleagues not currently enrolled in a course are not allowed to access or use the software available from this Web site."

Now I am not right clear about the part where it says "Friends, family and colleagues not currently enrolled..", since I am only worried about activation problems on two computers which I own and I only want to install Windows 8 on two computers, and the answer to the question I wrote in upper line says "Yes, as long as you are the owner of both computers and both are being used for educational purposes" and I am using the product for exactly this kind of use, wouldn't that mean, that I can use my Windows 8 without problems for activation on two computers?

And one more thing, if I am not too boring already. The link u provided have also other question saying "How many copies of a particular Microsoft product can I download?". And that is where it says the following "You can download the software available on DreamSpark.com and install it on your personal computer.  You may install it on more than one computer that you own (e.g. your laptop and your desktop). Certain Microsoft software on DreamSpark must be activated with single-use product activation key to use the software. These product activation keys are single-use. Once a product key has been used to activate the downloaded software, the same key cannot be used again." On my product of Windows 8 at the DreamSpark account doesn't say anything about being single-use. So my question for this is that, wouldn't there be a warning that it is for only single-use, as I try to download this product?

Thanks again for the reply, and sorry if I wrote too much, but I can't contact Dream Spark via their page.
