Licence issue not displayed on retail box RRS feed

  • Question

  • We purchased a retail box of Office Professional 2007 from ebay - I will be the first to admit that this sales channel is not the most reliable. However, we used the microsoft genuine website BEFORE purchase and this confirmed that the Certificate of Authenticity was a genuine 'retail' certificate. The disks also contained the correct holographic display once the unopened box was opened.

It is then only on validation that it refused to activate. On a call to the call centre to validate over the phone and several other calls, I have been told that the particular licence key included in the pack is part of a bulk licence and cannot be used on a new PC.

The certificate of authenticity does not state this, neither is there any note of this on the box. I find it very bad that Microsoft seem to have the view its all my fault that I purchased this software , when we have done our best to follow the correct instructions and this is indeed a retail box produced by Microsoft.

In addition, I wonder if there could be an error - Microsoft state that the key is for a volume licence, but could they have got this wrong. They state not possible, but mistakes can happen. There seems to be no way I can challenge this!

Does anyone think there is a legal case to challenge Microsoft here? I am shocked that Microsoft have not even offered any kind of gesture of goodwill, such as a discounted copy of the product for us to purchase.

    Many thanks

  • Hello Clubfinance,

Here is a snippet of your mgadiag report:

    OGA Data-->
    Office Status: 108 Invalid VLK
Microsoft Office Professional Plus 2007 - 108 Invalid VLK
    OGA Version: Registered, 2.0.48.0
    Signed By: Microsoft
    Office Diagnostics: B4D0AA8B-604-645_025D1FF3-230-1_025D1FF3-238-2_025D1FF3-258-3

Your installation of Office Professional Plus 2007 on your computer is a nongenuine installation.  It is a volume licensing installation that was done with an Invalid Volume Licensing Key.  An Invalid Volume Licensing Product Key is one that was generated by software pirates using a program called a key generator, or KeyGen for short.  This product key was never officially issued by Microsoft, making it Invalid.

Normally, legitimate users of Volume Licensing editions of Office are associated with larger business, educational, or governmental organizations.  If that's you, please contact your organization's IT support staff for further assistance.

If your use of this installation of Office Professional Plus 2007 is not associated with a larger business, educational, or governmental organization, and you purchased the installed copy of Office Professional Plus 2007 thinking that it was a retail license for Office Professional 2007 to be sold to individual consumers, it is likely that you are a victim of software piracy and/or counterfeiting.  As an individual consumer, you should never have been sold Volume Licensing (VL) materials such as the VL installation disc and you certainly should not have received a Invalid Product Key.  You should have been sold Genuine retail licensed software.

If so, your first course of action is to confront your seller with this information and demand a full refund.

If the seller refuses to help, please file a piracy report at www.microsoft.com/piracy.  Also, depending upon whether you received "high quality" counterfeit materials, you may qualify for the Office Complimentary Offer or for the Office Genuine Advantage discounted offer.  Please see the FAQ here:  http://www.microsoft.com/genuine/downloads/FAQ.aspx?displaylang=en#ID0EKNAC  If you think that you qualify for the Genuine Office Offer, apply for the Offer thru the "Learn More Online" or "Resolve Now" links that you see when Office fails validation at www.microsoft.com/genuine.

One other possibility is that at one time your computer did have a Genuine installation of Office installed, but for some reason it was replaced with the current installation which is nongenuine.  This could have happened if you took your computer to a repair shop and they reinstalled Windows and/or some or all of your programs.  You Get Genuine once again by uninstalling the current nongenuine installation of Office and using your Genuine Microsoft hologrammed Office installation CDs, along with the genuine Product Key found on your Office Edition's Certificate of Authenticity or yellow-orange Proof of License label, to put back the genuine installation of Office you may have already had on the computer.

Do what Dan says and I think you will find that it is, in fact, an invalid Volume license product that was produced as a counterfeit product.  There are different remedies once you find that the product is pirated.  Trying to sue Microsoft will absolutely get you no where except for a bigger attorney bill as they didn't make the mistake, you did by purchasing "on the cheap" on eBay.

  • OK, report below. LVTravel, I understand what your saying, although the box and contents do seem genuine, so it would seem that the counterfeiters obtained the box from Microsoft and maybe they did this illegally through a volume licence - in which case Microsoft should have this on the outside of the box so it can be clearly identified.

Let's make one thing clear - MS doesn't sell Volume Licenses of anything to the general public.
The minimum purchase level for a Volume License is 5 units - and the sale (except for the really big clients) is always through an intermediary. The purchaser then gets a single copy of the disks, in vastly different packaging to the Retail pack.
It is not possible to sell on Volume licenses individually.
Please go to the How To Tell pages, and check your disks and packaging against the examples there.

  • OK, have now sent back, got a full refund, seller did seem genuinely shocked that it didn't work. The box did look exactly like a full retail box per the howtotell pages and there was what looked like a genuine certificate of authenticity on the box and the key code was in the box exactly the same as a retail box we had purchase via Laptops direct (although it could have been another online company) - the disks had the holograms. I have reported the potential piracy.

Basically the take home message is you can only buy Microsoft products through one of their partner retailers and you have virtually no chance of selling it on second hand as everyone should assume that any microsoft product not bought through the correct channels is a fake even if it has a hologrammed CD and Certificate of Authenticity - because 'if' the one I had was a fake it is absolutely impossible for a normal person to tell except after you authenticate online.

I am also surprised given this type of fake exists that Microsoft would not want to try and investigate and find out how it is getting into the supply chain.

Microsoft tries hard but it's like killing cockroaches---every one you kill is replaced by two more.
