Client NIC goes offline during backup

Home Server is set up and I have shares working without an issue on this client. I can access the WHS console from this computer as well. This is a brand new Win7 x64 install with only a printer set up and WHS client connector added. I can start a manual backup either from this client or from the WHS and the client Nic dies around 35%. I have to disable and enabled the nic card on the Win7 client before I can get a network connection. All other computers on the network including WHS still has a good connection.
I have not been able to get a backup of this new computer yet. This happens on a scheduled nighly backup as well as a manual. In the am I find that the client does not have a network connection. It seems that the backup is somehow stomping on the nic and killing the connection. Am I misisng anything?

The Nic driver reports up to date when I attempted to update the driver.
Based on what drivers are on the client machine I guess. Did you look for an updated one for that Specific machine / Motherboard on the vendors website?
No other suggestions about "where to go/get it" due to limited client PC/NIC information

It looks like a bad NIC driver. Search for a new(er) one. No other suggestions about "where to go/get it" due to limited client PC/NIC information.
