Ebay Helping Software Pirates. RRS feed

  • Recently I was searching on ebay for a good Microsoft Office 2010 Professional. As Computer Tech and software specialist I know what to look for in infringed copyrighted software. SO i began to order these Office 2010 Software from EBAY. so far i found 4 pirated softwares and contacted ebay who has done nothing since these items are still being sold to unsupecting buyers. I have now taken this to the FBI and made a notice as to what is going on. the main software i have found to fake has a Yellow sticker from a company called Ingram Micro these pirated items have the sticker type as labels which can be pilled off and are hologramed as well. We as buyers really need to hit this hard with Ebay. they say they care about the buyers but yet they let these pirated items be sold on their site and then after the person refunds you your money they do not let you leave a feedback to warn others of this bogus ____. In a few pictures i have seen selling the Microsoft Office 2010 if you look hard You can actually see the Yellow sticker on the box in some of the ads this is the sticker from the IGRAM MICRO OR COVER IDENTITY for who selling or giving these items people to sell on ebay. look hard ask for a picture close up of the items you are buying. if you do not a darkness aorund the edge of the software then its not real. if the sticker label looks like a sticker then it probably is a peel off sticker. If you get one of these items take your finger nail to the outter edge of the label....If you can peel it or it stops your nail in place it is not real. also hold the DVD or CD up to the light look for small bubbles in the holgram. Microsoft does not use stickers they actually burn their label in the DVD/CD as part of the CD. with the outter edge being dark. Beware of Ebay and sellers making it to good to be true.

  • (preface: selling counterfeits on ebay is NOT limited to MS products)

By their "tacit approval" ( i.e. inaction) both ebay and MS are allowing
a very lucrative & profitable scam to be perpetrated on unsuspecting consumers.

People flock to ebay for Bargains; and assume the bargains are legitimate ( ex.  this poster)

For the most part, the selling of counterfeit MS Office Professional ( 2007, 2010 ) is thriving and continues UNABATED.
Counterfeiters, distributors, sellers and ebay are making good money on this counterfeit trade.

But once buyers (and the few naive, unsuspecting ebay sellers?) realized that some very unsavory organizations (i.e. terrorist supporters, drug cartels, large Asian countries, etc.) are profiting from this counterfeiting in a big-way, then perhaps it can be controlled; but ONLY with the involvement & intervention of governmental powers (CBP, FBI, DEA, NSA, DoD, State Police, etc.)
    It will also reguire
committments by Ebay and manufacturers to take legal actions against any intermediaries to this crime. ( think RIAA  ).

It will be some time before all this comes to pass.
So, in the meantime.... ( from personal experience ) ...

... if you discover you have received counterfeit MS Office 2007 software from an ebay seller...

    a) report it to the seller immediately and explain that MS has confirmed SW is
counterfeit and that you expect a refund for the SNAD item...
[>>> my complete-refund was instantaneous, and was not asked to return the item ]

    b) file dispute/report with ebay disclosing the counterfeit seller and
the item as "Significantly Not As Described" (SNAD), and is counterfeit!
( also, file reports for any other identical/similar listings for this or other sellers ( counterfeit ring ).

    c) Take full advantage of the "Genuine Office Complimentary Offer"
        http://www.microsoft.com/genuine/office/ogakitinformation.aspx?displaylang=en

    d)  (just an idea ... ? ) ...register a new, throwaway,  ebay-account ( false ID ) ...
then, buy all of the counterfeit MS-OFC Pro 2007 listings you discover.
Using outrageously high Max bids (sniping is best) to ensure you win auctions ...
...then forgetaboutit !  ( think of the affect of 100's or 1,000's of these false bidders, hmmm )

  • Microsoft is working to educate partners and consumers about the risks of getting software from unreliable, suspicious sources.  Microsoft is investigating the sources of counterfeiting operations and are doing everything in their power to stop this kind of activity. Purchasing from known and trusted sources and avoiding "too good to be true" deals are the best ways to avoid wasting valuable time and money on counterfeit or infringing software.

...and your problem and new information is??
You (as well as everybody who ends up here as a result) know that eBay sellers are mostly fraudulent - unfortunately, eBay works on the 'innocent until proven guilty' premise, which is naive, but not unreasonable.
MS chases as many of these vendors as it can - but they just disappear and pop up again under a different guise, and there's nothing that MS can do about that.
The Ingram Micro counterfeits have been doing the rounds for  months - and none of them have seen the inside of an Ingram Micro warehouse, as the sticker is counterfeited as well.
People who want something for nothing generally get what they deserve - nothing.
People who realise rhea state of the world are prepared to follow the advice given everywhere on the Internet (including eBay) and check out their vendors before purchase.

  • I received a counterfeit Office 2010 Professional from a eBay merchant in July, 2012.
In this case, I was able to prove it was counterfeit without opening the shrink-wrap. There were over 30 typos in the fine print on the side of the box.
The merchant told me my refund was delayed, but eBay Buyer Protection made it happen very quickly.

  • Glad  to hear that it worked for you - but you were lucky and sensible enough to check it out thoroughly before breaking the seal.

Most of the time, the people who arrive in these forums have had the counterfeit installed for weeks, if not months (or in some cases, years!). Their prospects of a refund from eBay or PayPal are next to zero, and the vendor has usually already done a runner.

MS has withdrawn the Complimentary replacement program for Office - but still operates a similar program for Windows in some areas of the world, if not everywhere.

The pirates have got VERY good at this over the past few years, as the price of equipment for manufacturing the packages drops, and as factories open in less well-policed countries.
