Yes it is - but if you want to get any action out of eBay/paypal, then your should post the WHOLE MGADiag report - then Darin can check against MS's internal database and give an 'official' response.
To properly analyse and solve problems with Activation and Validation, we need to see a full copy of the report produced by the MGADiag tool (download and save to desktop - http://go.microsoft.com/fwlink/?linkid=52012 )
    Once saved, run the tool.
Click on the Continue button, which will produce the report.
To copy the report to your response, click on the Copy button in the tool (ignore any error messages at this point), and then paste (using either r-click/Paste, or Ctrl+V ) into your response.

No need to activate at all for MGADiag to be able to do its thing :)
It's definitely an MSDN/TechNet Key - Darin will be able to confirm this officially on Monday when he gets into the office (Redmond time)
Don't waste time waiting for him, though - demand a refund (NOT a replacement) from the vendor, and lodge a complaint with whatever umbrella site you used.
The following two stickies should help explain your situation, and help you avoid getting caught again....

  • Thank you very much.

I have just opened ebay and paypal controversies and ask directly for a full refund to the vendor.
