    I created a custom enity and made it a activity.  Can i set a custom activity created in mscrm 2011 to alway be in an open status

    Yes. Simply write a workflow that triggers whenever an activity is closed and reopen it.

    Another option is to write a plugin that triggers on status changes and set status back to original using PreImage.
