  if he only had read access then there should be no way he could have deleted them

   

  have you tried rebooting your WHS and checking the folder again?

   

  are there any disk warnings appearing?

  i forgot to mention that when i checked the "previous version" they were all gone there aswell

  I think your only option left is to shut down the server, pull each drive out one at a time, hook each one up to another computer, and use a data recovery program to see what can be retrieved (and, if you are going to go that route, the sooner you do it, the better your chances are of retrieving the data).
