activation issue with vista basic RRS feed

  • Question

  • I recently replaced the motherboard of a computer that I purchased a couple of years ago. It came with windows vista basic. After replacing the motherboard plugged it back in and it started ok but it replaced/reloaded a bunch of drivers (probably something to do with the new motherboard) then vista told me that activation was requires. I hit ok and it told me that I had an invalid product number. I rechecked the number in the back of the computer and re-entered it, did not take. Vista is suggesting that I re-purchase it or enter a new number... which I don't have.

I read through the previous post and found this solution:

Alternate steps to change the product key:

    1)   1)     Click the Start button

    2)     Type: slui.exe 3 and hit the Enter key

    3)     Type in the Product key from the sticker on your computer

    4)     Click the Next button.

    5)     You will be asked if want to Activate, click ok

    6)     It will attempt to Activate by the internet and will return an Invalid Key error (this is ok, continue to step 7)

    7)     Click the Start button

    8)     Type: slui.exe 4 and hit the Enter key

    9)     Select your location in the drop down menu and click the Next button

    10)  The next screen provides the number to call to Activate by Phone

I followed the steps but when I tried running the slui 04 program but it but I never get to the "Activate by Phone" screen... it always goes back to the buy new, use new number, contact the manufacturer.

I realize that the intent of this activation process is to prevent piracy but this process is keeping me from activating the product that I obtained though legal means.

    Any help? Thanks!

  • Hello gfnin,

Here is a cut-n-paste from a licensing FAQ at the Microsoft OEM website:

    Q. Can a PC with an OEM Windows operating system have its motherboard upgraded and keep the same license? What if it was replaced because it was defective?

    A. Generally, you may upgrade or replace all of the hardware components on your customer's computer and the end user may maintain the license for the original Microsoft OEM operating system software, with the exception of an upgrade or replacement of the motherboard. An upgrade of the motherboard is considered to result in a "new personal computer" to which Microsoft OEM operating system software cannot be transferred from another computer. If the motherboard is upgraded or replaced for reasons other than a defect, then a new computer has been created and the license of new operating system software is required. If the motherboard is replaced because it is defective, you do NOT need to acquire a new operating system license for the PC as long as the replacement motherboard is the same make/model or the same manufacturer's replacement/equivalent, as defined by the manufacturer's warranty.

The reason for this licensing rule primarily relates to the end-user license agreement (EULA) and the support of the software covered by that EULA. The EULA is a set of usage rights granted to the end-user by the PC manufacturer and relates only to rights for that software as installed on for that particular PC. The System Builder is required to support the software on that original PC. Understanding that end users, over time, upgrade their PC with different components, Microsoft needed to have one base component "left standing" that would still define that original PC. Since the motherboard contains the CPU and is the "heart and soul" of the PC, when the motherboard is replaced (for reasons other than defect) a new PC is essentially created. The original System Builder, therefore, can not be expected to support this new PC that they in effect, did not manufacture.

  • Hi Dan,

The computer was working but it was barely functional, it was extremely slow. The processor was at 100% from the get go never slowing down not even a bit. I wan unable to do the things that I want to do with it... like edit video from my miniDV camera for instance.

I spoke to friends and colleagues about the problem and the suggestion was to first try adding more memory… did that, upgraded from 512 mb to 2 giga bites… no change, processor still at 100% from the get go then they said that I should upgrade the CPU… well... when I started to do my research on obtaining and replacing the CPU I found out that the CPU with that type of socket was no longer available and that I had to replace the motherboard to get a different CPU… that is when I made the decision to change out the motherboard… never had an idea that it would end up with this headache.

So I replaced the motherboard and CPU… the rest of the computer remains the same… same box, same power supply, same drive, same optical disk, same keyboard and mouse, same… you get the picture… and when I fired up the computer with the  new motherboard it ran ok. It loaded up a few drivers to support the new motherboard and then it announced that I needed to re-activate the product… the rest of the story you know.

  • Hello gfnin,

By replacing the motherboard, for licensing purposes you have created a new computer.  (If you had replaced everything else but the motherboard, it would have remained the same computer for licensing purposes.)

You can no longer use the OEM license for Windows that originally came with the eMachines computer because, since you replaced the motherboard with a non-eMachines motherboard, the OEM End User Licensing Agreement prohibits moving an OEM license from the computer onto which it was first installed.

In order to run a correctly licensed copy of Windows on the newly created computer, you need to purchase and install another copy of Windows.  If you purchase an OEM license you will save money as compared to full retail, but the limitations of the OEM license, as you just experienced, will prevent you from upgrading your motherboard in the future.  OTOH, if you purchase a full retail copy of Windows, the EULA permits you to move the license to another computer.

Many people are not aware of these licensing limitations until they are in the middle of a situation, as you are.  In your situation I might consider going forward from this point with a beta copy of Windows 7 installed, and then purchase a copy of Windows 7 when it is released late this year or early next year.

  • Well… That’s terrible news Dan.

When I read the documents from Microsoft I don’t believe that this was the original intent of making the end users activate their product.  I thought it was supposed to be to prevent piracy not to require users to re-purchase a new license when upgrading and/or repairing their PCs with legally acquired OS software.  I did pay a certain portion of the overall cost of the computer towards the OLM version of windows Vista Basic and even though MS position is that this is a new computer, everything I know about it is that it is the same old computer only a little faster. My performance number went from 2.7 to 3.1. If I had to do it over again I would not have spent the money it cost me to replace the motherboard and now the bad news… I have to re-purchase something I already bought. That’s not right. By the time you take into consideration the cost of a new motherboard, the CPU and the new OS I will have over $500 into the same old PC. I would have bought me a new PC for that kind of money with all new parts.

Do you know how can I legally obtain a new OLM copy of windows vista? How much money it will cost me. Can I buy it at a discount since I already bought it once and MS is making me buy it again? What about if I purchase an upgrade to vista home premium? Would it solve my licensing problem? Please help me out here, I’m trying to do the right thing.

About Windows 7 how long will the beta test license last? I just hate to install a beta version that might be buggy and a year from now or perhaps even later this year I’m sure MS will want me to give them the full price for the software even though it will be going into a PC that it’s essentially 4-5 years old by the time windows 7 comes out. Yea, the motherboard will be a year old but all else is original and on its way to obsolescence.

What other options do I have? My grace period expires in 4 days and by the time you respond it will probably be only 3 days. Can I downgrade to an old window XP version that I have that is not an OLM version?

Dan, please take the time to answer all or most of my questions.  ~Frank

  • Hello gfnin,

OEM licenses for Windows are permanently married to the computer onto which they are first installed and the End User Licensing Agreement (EULA) does not permit them to be moved to any other computer.  To read the EULA (or SLT=Software Licensing Terms), click Start, type winver, and then in the resultant window, click the link to read the Software Licensing Terms.

This means that the license for Vista Basic that came with the eMachines computer (which really means the original eMachines motheboard in your set of circumstances) is tied to the eMachines motheboard.  If you were to assemble another computer around the original motherboard, it would retain the original license and would be legitimate to run the OEM emachines copy of Vista Basic.  You would also want to keep the motheboard together with the corresponding Certificate of Authenticity from emachines with the Product Key.

Full retail licenses, OTOH, can be moved from one computer to another.  As you mentioned, if you have a full retail license for XP handy, you can install this full retail license with its corresponding Product Key on the "new" computer and it will activate and validate just fine.  If the license is currently installed on a computer, if full retail you can uninstall it from that computer, install it on the "new" computer, and upon activation the license will be moved to the "new" computer.

When I am looking to purchase OEM licenses for Windows, I usually shop at www.newegg.com or www.buy.com .  A single OEM license for Vista Home Basic generally sells for around $85-95.

An upgrade license to anything will not work on the "new" computer because it is a bare computer without a Windows license, therefore there is nothing to upgrade from.  "New" computers need either an OEM license or a full retail license.

Windows 7 is in beta right now and the Release Candidate is widely expected to be available before the end of June 2009.  Microsoft typically schedules its betas and RCs to expire within a couple of months of the anticipated release date of the final product.  Rumor Control says the "real" Windows 7 will be available to the public for sale somewhere between November 2009 and February 2010, so if you got the beta now, and the RC in June, you should be OK till about March 2010.  Windows 7 beta is remarkably well-behaved for a beta, mainly because it is really a more refined version of Vista, and Windows 7 has been reported to have somewhat better perfomance than Vista on the same hardware.

Hopefully the above info will help you make a good decision.  Good Luck! :-)

  • I don’t believe this is consistent with MS original intent of activation for software. If I own a legally obtained license for one of your products I should be able to use it in one computer. Up until now I've never heard the motherboard referred as "the" computer. To me the motherboard is just one of the many components.

By the way windows 7 beta is no longer available for download.

I’ve been a loyal customer of MS for many years. I may have to rethink where my loyalty lies.

  • Hello gfnin,

While I am not a Licensing Expert, my understanding of OEM Licensing terms agrees with what Dan has told you.

  • OK, thanks for your help, I will check www.newegg.com to see about buying a new OEM version of windows vista. I suppose that since the motherboard "is" the computer I'll put the motherboard, CPU and recovery disk on Creigslist.com and hope someone gives me $60 for the whole thing.

    Thanks!
