firewall turns itself off

my firewall keeps turning itself off, when i check for an update it tells me updates are available but upon trying to download it the program stops and tells me my firewall is up to date! im concerned i may have a spy. what should i do?

(i have windows vista)

Is this the One Care firewall, Vista firewall,or a third party firewall?
