Using Dell OEM Vista installer to HP notebook

I just need some confirmation regarding Vista genuine validation process.
We have a discussion in HP forum thread regarding genuine validation issues

A user of HP notebook has difficulties obtaining Vista recovery disk from HP, to cut long story short, He installed Vista with Dell Vista DVD installer that have the same version as his and use the product key from HP OEM COA. Online validation works without any problems and an other member also confirm it with her own experiences.
As I read here and elsewhere, product key from COA needs offline activation, by phone if I'm not mistaken.
I would like to ask a few questions:
1. Do product key from OEM COA can be used for any Vista Installer? or only OEM Vista installer?
2. Do validation process can now be done with online activation?
3. Is it legal to use other OEM Vista DVD installer since there is a note something like "For distribution only with a new OEM name PC"

Thank you for visiting us today. Basically what your describing is going against the End User Licensing Agreement "EULA". The person will need to work with HP and aquire the right OEM Recovery media for the machine.Since the telephone number and websites are not maintained by Microsoft we cannot make any warranty as to their validity.

Thank you for the information.Please contact the Microsoft Supplemental Team and ask how you may replace Microsoft Software.

Thank you for the answer.
If I may conclude your answer as:
1. From legal point of view, they are against EULA.
2. "Microsoft cannot make any warranty as to their validity " may I rephrase the statement as "their genuine activation may be withdrawn in the future?"
About HP, as reported in that thread, HP do not have Recovery Disks for that model anymore. This problem may not happen if HP provides OS recovery to buy and it is not their intention to violate EULA, the condition make them to do it.
