    The pirates have got VERY good at this over the past few years, as the price of equipment for manufacturing the packages drops, and as factories open in less well-policed countries.

    Yes, it's counterfeit.
    The whole package was produced outside any of MS's control.

    You won't get that from anyone here - point your supplier at this thread, and remind them that counterfeiting is illegal, and warrants a visit from the police and other enforcement agencies, who tend to take rather a dim view of distributors of counterfeits.

  • This item was puchaced from ebay i have complained to ebay and paypal plus put in a report to microsoft piracy yet this seller is still allowed to sell pirated software is anyone going to put a stop to this ?

  • If the seller runs true to form he will make refunds for returned merchandise until he is ready to dump and run.  That keeps eBay from kicking him off the site because he is still within the rules.  But the complaints will become frequent enough that he won't want to make any more refunds and then he is gone.  We won't see any prosecutions or other punitive actions so it looks like these crooks are getting away with it.  No doubt some do.

  • Both eBay and PayPal have procedures that they have to follow before they take action against vendors - these procedures take time, and probably require multiple complaints against the vendor before anything other than an exchange of emails takes place.

    Eventually, either there will be sufficient complaints against the vendor that eBay locks their account - or the vendor will know that the end is nigh, and cut and run.

    MS takes all complaints of piracy seriously - but there's little they can do about eBay vendors who don't publish names and addresses, as it takes court orders to get information required to identify them, and rules of evidence apply, which means that they have to purchase such items themselves, and then pursue the vendor that way. Again, this takes time, and often by the time they are involved, the vendor has already rn for the hills.

  • Paypal now require proof of Destruction IE that the item in question was destroyed as it is illegal and cannot be returned.They require documentation that the item was destroyed as well as a signed declaration . Any ideas where I can obtain these or have the item destroyed so as i can get documentation. I cant believe they are making me run around the ringer for a refund. I really am sour with this process and am in two minds whether to cancel my account.

    As well I have not heard back from Microsoft piracy.

    This policy appears to be new - from my reading of their policy, they should have informed you in their email as to what are acceptable destruction procedures. If not, please ask them for clarification, as we cannot be part of this dispute.
    As Colin says, the probability is that the local police may be able to assist, but check with eBay first as they may have special arrangements or requirements.

    It certainly looks like a counterfeit to me, based on the price alone, and the fact that the seller has very few (relatively) feedback reports, almost all of which are very recent
     
    I note that he's bought a few copies form other vendors, so he may just have got caught by them, but I'm suspicious of the listings for them - they look very much as if they were created by the same person.
