Best Buy-purchased in error

  My son built two computers and went to Best Buy to buy 2 operating systems.  Purchased, excited, came home-tried to load one.  Found out he had purchased Windows Upgrade instead of OS.  Best Buy took back the one that wasn't opened but refused to return the other one because of copyright laws.  Are there any options so he doesn't lose the money and have no use for the upgrade?  Thank you.
